AT LAST, A GROUP I CAN UNDERSTAND!  A PLACE TO LEARN. . . OR RANT. . . ABOUT UNDERWRITERS. 

Charles Dailey has introduced a new group, UNDERWRITING, that should be of interest to all real estate agents and brokers who have ever had a home buyer's loan application rejected by an underwriter, which probably includes every agent and broker who has had more than 5 settlements.  

WHO WILL WANT TO JOIN THIS GROUP??  Any ActiveRain member who:

Has ever worked with a home buyer who has:Showing Homes

1. Searched for homes for weeks/months/years and finally. . . . finally, find the perfect house,

2. Managed to get a ratified Contract of Sale after a week of serious gut-wrenching negotiation,

3. Made loan application with a loan officer who speaks to the prospective borrower in Uniform Residential Loan Application (Form1003) 'ese. 

4. Produced documents to a loan processor who works at a custom built desk the right side of which is a shute that leads to a BLACK HOLE and who was trained at birth to advise borrowers, "If I don't get a copy of your third grade school transcript by 3:00 p.m., your loan application will probably be rejected."

5.  Manage to hurdle through steps 1 through 4 only to hear from the loan officer 2 days before the scheduled settlement date in the Contract of Sale with a "Time Is Of The Essence" clause, that. . .   

"the file is in UNDERWRITING".

6.  Then, about 24 hours prior to the scheduled closing, as you drive to the airport to pick up your home buyer who traveled 3,000 miles to attend the closing, you receive a phone call from the loan officer that the Underwriter wants:

     * Another appraisal.

     * Another comp with a kitchen in the upper level, such is found in the subject "Bi-Level" floor plan of which only 3 exist in a 10 mile radius and none have sold for 5 years.  The Underwriter doesn't want to use the Appraiser's Split Foyer, Split Level, Colonial or Rambler models with similar square feet and amenities.  Home Improvement

     * All of the contractor receipts for upgrades to the property in the past 3 years to justify the remodeled price accepted by the home buyer, the county permit office and the appraiser.

     *Another appraisal.

While the experience of many real estate agents and brokers will differ from the above actual Underwriter rejects, if you've been around this business very long, you've experienced similar experiences, or heard of them from other agents and brokers.

ADVICE TO AGENTS: BEWARE THE TICKLER FILE:  Try to find out from the loan officer if their mortgage company policy is to permit loan officers and processors to operate with a "tickler file" system.  This file management system is dangerous to the health of your buyer and their agent.  It will insure that the processor will wait until the very last minute to demand additional documentation after the buyer has already produced every document in their possession.  Don't do business with loan officers who sell themselves to prospective borrowers and "turn the file over to their processor".  The loan officer sold the loan, they should know what's going on with it. 

One of my favorite "tickler file" last minute requests is the processor who contacts the buyer with a demand for a letter from their landlord detailing the dates of their rent payments for the past 2 years and if they don't get it to the processor before 3:00 p.m. (the day before settlement), their loan will be rejected.  Yes, that actually happened.

Many years ago, I was advised by a wise managing broker, when I inquired about the duties of the Underwriter, that:

  • An agent's job is to sell a house.
  • A loan officer's job is to prepare the loan application file for Underwriting.
  • An Underwriter's job is to blow holes in it.

Back in early February, I brought the 4 pots of Tulips I was "forcing" in my garage.  I'm not sure of the date when these bulbs were planted but it would have been around November or early December.   I'd have planted them in the yard, but I just never got to it.  So, in the pots of soil they went, covered and placed on a table in my garage. 

Early February, I could see the "shoots"peeking through the soil, so I brought them in, watered them thoroughly, put them in a sheltered location in a corner of the Kitchen to avoid shock.   About 2 weeks ago, I put them in my Sun Room.

    WHICH COMES FIRST, THE AGENT OR THE LENDER??? WHICH COMES FIRST, the chicken or the egg??? Depends on your expectation for the hatch!

    Inspired by Jeff Belonger, who believes that a consumer should begin their home buying adventure by selecting a lender first. 

    I DISAGREE. 

    SEE:  As a first time homebuyer, not knowing anything about buying a home, where do I start? Realtor or Loan Officer??   

    Jeff wrote:  "Do you know anything about mortgage insurance?"

    If an agent or a consumer needs to understand MI before representing a buyer, then it would seem that a loan officer would have to understand the real estate market/area before recommending a real estate agent. 

    Until and unless loan officers have a duty of fiduciary to a borrower, the best resource for unbiased and knowledgeable recommendations for any real estate related service is an experienced REALTOR.

    Which comes first, the chicken or the egg?  I would suggest that, if you want to hatch a chicken from an egg and not a stegosaurus, best to start with a chicken and not an egg.  The outcome is more reliable.

    One reason I do not accept buyer referrals from loan officers is because I have a duty of fiduciary to the buyer with whom I have a representation agreement.  If a loan officer refers a buyer to me and I believe that the buyer would be better served by another mortgage company or loan officer, I would have to compromise either my duty to the buyer or a sense of loyalty to the loan officer to recommend that the buyer consider another lender.  That has happened to me in the past and is the reason I don't accept lender referrals. 

    If one wants comprehensive real estate advice and guidance, start with an experienced real estate agent.  Once the buyer is close to making a buying decision, we'll get prepared with a lender's letter.  Untill that time, we don't need it.

    TOTOH, if the real estate licensee is inexperienced, they shouldn't be making any recommendations for any real estate services without guidance from their broker.

    An interesting article by J. Philip Faranda  this a.m. got my attention because I have not practiced DUAL AGENCY since 1994. 

    Phil wrote:  "How does seeing the house with you and deciding they want it make them a client? They are a customer! Big difference! You owe them fairness and honesty. But they aren't clients."

    BINGO! 

    "HOW DO YOU DO THAT, LENN??" 

    EASY.  ALL YOU HAVE TO DO IS UNDERSTAND THE DIFFERENCE BETWEEN A CLIENT AND A CUSTOMER.

    A simple explanation of the difference between customer and client is: 

    Homefinders.com is a Single Agency Broker.  I will represent a Buyer OR a Seller as a client, but never represent a Buyer AND a Seller for the same property

    If I'm the listing agent, I represent the Seller as my client and the Buyer is a customer

    If I'm the buyer's agent, I represent the Buyer as my client and the Seller is a customer.

    EXAMPLE:  An unrepresented buyer views my listing with me with disclosure in writing that I represent the Seller.  Buyer wants to buy the property.  I sell it to them as a customer but DO NOT represent them.  I treat them honestly with disclosures and manage any documents required to transfer ownership from the Seller to the Buyer.  If the Buyer/customer desires agency level information, i.e., pricing advice, etc., they will not get it from me.  They are always advised to obtain the services of an agent to represent their interests. 

    EXAMPLE:  Representing a Buyer interested in purchasing a FSBO, the unrepresented Seller is noticed that I represent the Buyer/Client and the Seller is a customer.  I will manage the documentation to complete the transaction and provide disclosures regarding Buyer's qualifications to buy.  However, I do not provide the Seller with pricing advice.  If the Seller desires agency level advice, they should obtain the services of another broker/agent to represent their interests.

    Once an agent understands the difference between customer and client and understands the meaning of the word representation, there would be no dual agency problems. 

    Of course, the real hurdle is in public education.  Buyers and Sellers will still call you "their agent" even when you are not.  They will still believe that you will promote their interests even when you will not.
